By accessing and purchasing from maharajagems.com, you agree to be bound by these terms, all applicable laws and regulations, and you are responsible for compliance with the laws of your own jurisdiction.

1. Products & Certification

We deal in natural coloured gemstones and fine jewellery. Where a piece is accompanied by a gemmological laboratory certificate, the certificate is issued by an independent laboratory and represents that laboratory's opinion at the date of issue. Gemstone colour varies with lighting and display screens; photographs and videos are as accurate as reasonably possible but are not a contractual representation of exact colour. Carat weights, measurements and treatments are stated as certified or as assessed by us in good faith.

2. Pricing & Currency

All prices are set, and all payments are taken, in United States Dollars (USD). Prices shown in other currencies are indicative conversions for convenience only. We reserve the right to correct pricing errors; where an order has been placed at a materially incorrect price we may cancel it and refund in full.

3. Orders & Payment

Pieces priced under $50,000 may be purchased through online checkout, with card payments processed securely by Stripe — we never see or store your card details. Pieces priced at $50,000 and above are sold exclusively by private arrangement: viewing (in person or virtual), payment by bank transfer, and individually agreed written terms. An online order constitutes an offer to purchase which we accept on dispatch; we may decline or cancel any order before dispatch (with a full refund) including where our payment or anti-fraud verification is not satisfied. Each gemstone is unique — quantity is one, and a stone in another customer's checkout may become unavailable.

4. Shipping, Returns & Verification

Shipping, insurance, our tamper-evident security seal, and the value-tiered return policy — including verification of returned stones against their certificates before refund — are set out in our Shipping & Returns policy, which forms part of these terms. Title to a piece passes on receipt of payment in full; risk passes on delivery.

5. Use License

Permission is granted to temporarily download one copy of the materials (information or software) on Maharaja Gems' website for personal, non-commercial transitory viewing only. This is the grant of a license, not a transfer of title, and under this license you may not: modify or copy the materials; use the materials for any commercial purpose, or for any public display (commercial or non-commercial); attempt to decompile or reverse engineer any software contained on Maharaja Gems' website; remove any copyright or other proprietary notations from the materials; or transfer the materials to another person or "mirror" the materials on any other server. This license shall automatically terminate if you violate any of these restrictions and may be terminated by Maharaja Gems at any time.

6. Disclaimer

The materials on Maharaja Gems' website are provided on an 'as is' basis. Maharaja Gems makes no warranties, expressed or implied, and hereby disclaims and negates all other warranties including, without limitation, implied warranties or conditions of merchantability, fitness for a particular purpose, or non-infringement of intellectual property or other violation of rights.

7. Limitations

In no event shall Maharaja Gems or its suppliers be liable for any damages (including, without limitation, damages for loss of data or profit, or due to business interruption) arising out of the use or inability to use the materials on Maharaja Gems' website, even if Maharaja Gems or a Maharaja Gems authorized representative has been notified orally or in writing of the possibility of such damage.

8. Governing Law

These terms and conditions are governed by and construed in accordance with the laws of Dubai, UAE and you irrevocably submit to the exclusive jurisdiction of the courts in that State or location.
